Using our Services

This website along with the game "4 in a Row Master" and all accompanying services that are needed for the game to work properly and to improve it in the future (collectively referred to as "Services") has been provided by Vladimir Lozanovski (hereinafter referred to as "we", "us", or "our").

These terms apply to your download, access and/or use of the game on any device or platform. These terms also apply to any other services that we may provide in relation to the game or the website, such as customer support, social media and community channels. These terms contain important information about your rights and obligations in relation to our Services.

If you do not agree to these terms or any future updated version of them then you must not access and/or use, and must cease all access and/or use of, any of our Services. If we require that any future update to these terms requires any action from you in order to accept the updated terms, then you may not be able to continue to use the Services until you have taken such action.

You're not allowed to copy or modify the game or part of the game in any way. You're not allowed to attempt to extract the source code of the game, to translate the game into other languages or to make derivative versions. The game itself, and all the intellectual property rights related to it still belong to us.

For use of our online features in the game, you agree that you are at least 13 years old and that if you are between 13 years and 18 years old, your legal guardian has reviewed and agrees to these terms and has allowed you to access and use our Services.

When you use our online features in the game the publicly displayed nickname can be changed. If you choose to change the nickname and are between 13 years and 18 years old, you agree that your legal guardian has reviewed and agrees to the use of the new nickname.

We are committed to ensuring that the game is as useful and efficient as possible. For that reason, we reserve the right to make changes to the game or to charge for its services at any time and for any reason. However, we will not charge you for the game or its services without making it clear to you exactly what are you paying for.

The Services that we provide store and processes personal data that you have provided to us in order to provide the Services. It's your responsibility to keep your device and access to the game secure. We, therefore, recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official manufacturer of your device. It could make your phone vulnerable to malware, viruses and/or malicious programs, compromise your phone's security features and it could mean that the game won't work properly or at all.

We expressly reserve the right to change these terms at any time without prior notice. You acknowledge and agree that it is your responsibility to review this website and these terms on a regular basis and to familiarize yourself with any modifications. Your continued use of our Services after such modifications will constitute acknowledgement of the modified terms and agreement to abide and be bound by the modified Terms and Conditions.

You should be aware that there are certain things that we will not take responsibility for. Certain functions of the game will require the game to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but we cannot take responsibility for the game not working at full functionality if you don't have internet access, or your internet connection is not reliable.

If you're using the game outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing our Services, or other third-party charges. By using our Services you're accepting responsibility for any such charges, including roaming data charges if you use the Services outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you're using our Services, please be aware that we assume that you have received permission from the bill payer for using our Services.

Along the same lines, we cannot take responsibility for the way you use our Services, i.e. you need to make sure that your device stays charged - if it runs out of battery and you can't turn it on to avail the Services, we cannot accept responsibility.

With respect to our responsibility for your use of the Services, when you're using the Services it's important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. We accept no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the Services.

We may publish an update for the game at any time. The game is currently available on Android and iOS. The requirements for both platforms (and for any additional platforms we decide to extend the availability of the game to) may change, and you'll need to install the updates if you want to keep using the game. We can not always update the game so that it is relevant to you and it works with the device that you have and/or the operating system version that you have installed on your device. If needed, we may publish an update which is mandatory for the online services in the game to work properly and if the version that you have on the device is not updated, then all online services may be disabled or may not work properly. Hence, you should always accept updates to the game when offered to you.

At any given time we may decide to update or modify the software on our servers, and that may result in a downtime during which the online services of the game will not work. This may happen for any reason, like regular maintenance, adding a new feature, software and/or database update. There may also be a downtime introduced by our hosting provider for any reason. We accept no liability for any loss, direct or indirect, you experience as a result of this.

Termination

You agree that we may, in our sole discretion, terminate or suspend your access to all or part of the provided Services with or without notice and for any reason, including, without limitation, breach of these terms. Any suspected fraudulent, abusive or illegal activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities.

Upon termination or suspension, regardless of the reasons therefore, your right to use our provided Services immediately ceases, and you acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account and/or ban any further access to such files or the Services. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection with such termination or suspension.
